Statutory accident insurance while working abroad

The statutory accident insurance mostly covers work that is carried out in Finland or on board a ship under Finnish flag. In some cases work carried out abroad or on board a ship under another flag than Finland´s falls within the scope of the Finnish statutory accident insurance.

The insurance cover for a person working abroad is determined among other things on the basis of in which country, for how long and on whose behalf the person is working.

WORK IN EU-STATES AND SOCIAL SECURITY AGREEMENT STATES

The main principle regarding work in EU-states and social security agreement states is that the employee is insured in the country of employment. In certain cases a person who is working abroad in another EU-state, or on board a ship under another EU-flag, on behalf of a Finnish employer, remains included in the Finnish social security system and the statutory accident insurance. Regarding Finnish citizens the decision on which country´s social security legislation is applicable is made by the Finnish Centre for Pensions. The decision is among other things affected by on whose behalf the work is carried out and if the posting abroad is temporary or not.   

WORK OUTSIDE EU-STATES AND SOCIAL SECURITY AGREEMENT STATES

A person who is temporarily working abroad outside the EU- and social security agreement states or aboard a ship under non-EU flag on behalf of a Finnish employer, remains included in the Finnish social security system and statutory accident insurance. In these cases there are no rules for coordination of the social security systems in the different countries.  The employer can therefore in certain situations be obligated to insure the employee both in Finland and in the country where the work is carried out.

FOREIGN EMPLOYEES IN FINLAND

As a rule an employer has to insure a foreign employee working in Finland or on board a ship under Finnish flag in accordance with the Workers' Compensation Act in the same way as Finnish employees. The nationality of the employee or the domicile of the employer does not affect the employer´s duty to take out insurance.  A foreign employer may nevertheless be exempted from the obligation to insure employees temporarily posted to Finland, if the posted employee has a certificate stating that he or she remains in the posting country´s social security system.
